Even if a Will is wrong, it may not be too late:
By varying a client’s Will we managed to put some property into
a Will Trust thus ensuring that Capital Gains on some very valuable
properties fell outside the survivor’s estate and were made available
for the next generation, without loss of income or flexibility for the
survivor due to careful planning of the nature of the estate.
Do you have some inherent future tax problems within your
sole trader or partnership business?
We have been successful in incorporating just such a business, and by
getting the timing right saved the client some £80,000 in tax
that would have arisen had the private stream been taxed within the
sole trader or partnership business.
Have you experienced the horror of employee theft?
We have been able to help a client through just such an incident and
enabled them to mitigate the cost of the loss, implement appropriate
systems to prevent this happening again and assisted in replacing the
relevant staff members, and rebuilding full trust within the workplace.
Do you have a valuable asset tied up in a limited company?
We have been successful in extracting a valuable asset at a minimal
tax cost to the client with the end result that the gain now arises
in the more beneficial tax regime that exists for assets held by individuals
as opposed to companies.
Are you desperate to buy that (commercial) development
property?
We are advising a number of clients on the impact of the changes after
“A” day for pensions (2006). By appropriate pension funding
within companies and personally we have been able to both save significant
tax and make assets otherwise tied up available to use within a client’s
investment strategy.
Do you have valuable share options?
By the judicious transfer of shares between husbands and wives we have
been successful in significantly reducing the tax arising on the realisation
of such options.
